The Board of Registered Nursing issues citations against California nurses for minor criminal offenses.  We have seen citations after convictions for driving under the influence of alcohol (DUI) and alcohol-related reckless driving (aka wet reckless).  We have also seen a citation after a domestic violence arrest where no criminal charges were filed.

California Nurses Under Investigation: What to Say When the Board of Registered Nursing Comes Calling

An investigation by the California Board of Registered Nursing usually starts with a telephone call or letter.  The best course of action is to have an attorney promptly respond on your behalf.  Sometimes, the investigator will start asking questions during the first phone call.  Rather than answering questions, we recommend that you ask what the investigation is about and inform the investigator that you plan to cooperate with the investigation after retaining an attorney. California Board of Registered Nursing Dismisses Accusation Against R.N.

The California Board of Registered Nursing filed an Accusation against a registered nurse (R.N.) seeking discipline based on revocation in another state.  In fact, our client’s license had been reinstated in the other state.  We presented documents explaining the nature of the out-of-state revocation and reinstatement, and the Board of Registered Nursing dismissed the Accusation.

A California registered nurse (R.N.) was convicted of alcohol-related reckless driving after being charged with driving under the influence of alcohol (DUI).  The conviction was a first-time offense, and there was no evidence of alcohol abuse or dependence.

Nevertheless, the Board of Registered Nursing demanded that the nurse submit to a psychological evaluation, physical evaluation, random urine tests, and substance abuse rehabilitation.  Since there was no evidence of any alcohol problem, we believed that the conditions demanded by the Board were unreasonable.
