California Physician

If you need a California medical license defense attorney, contact us as soon as possible.  We defend physicians before the Medical Board of California in license denial and disciplinary action cases from investigation through administrative hearings and on appeal.  We also represent doctors in matters involving the National Practitioners Data Bank (NPDB), hospital privileges, and Medical Provider Networks (MPN).

We defend physicians (and physician assistants) in the following areas:

Medical Board Petition to Terminate Probation Early Granted

A psychiatrist was put on probation by the Medical Board of California following an administrative law hearing in 2010 after an accusation charging negligence and record keeping violations had been filed.  The doctor was found negligent for failing to provide adequate means for patients to make contact on an emergency basis, as well as record keeping violations.  The term of probation imposed was five years, with requirements that courses in Ethics and Record Keeping be completed.

MEDICAL BOARD COMPLAINTS: WHAT EVERY PHYSICIAN SHOULD KNOW

A letter from the California Medical Board arrives at a physician’s office. It informs the doctor that a patient (or family member) has filed a complaint. The letter demands a certified copy of the patient’s medical records and requires the physician to submit a written statement of care in defense of the complaint per Bus. & Prof. Code § 800 (c). A two week deadline is usually imposed--not long for a physician with a busy practice. What should the doctor do? Does he or she need an attorney at this point?

Legislation Attacks Physicians Prescribing Pain Medications

Lately there has been a lot of noise in the news media about the Medical Board of California and question of whether doctors are over-prescribing pain medications.  As California administrative law attorneys representing doctors in accusation hearings, we are concerned when the public focus turns to blaming doctors and physician assistants for the lack of treatment and control of drug addiction, rather than looking to the source of the problem o

The Medical Board issues medical licenses and investigates doctors for misconduct, including negligence and criminal charges.  The Board can file accusations leading to administrative law hearings.  Citations, license revocation, suspension, or probation for physicians and physician assistants can result.  As California medical license defense attorneys, we are concerned when the rules that govern Medical Bo

Medical Board Terminates Physician's Probation Early

The Medical Board of California granted our Petition for Penalty Relief after an administrative hearing.  Our client is a physician who accepted his original California Medical License with five years of probation because of a conviction for driving under the influence of alcohol as a medical resident.  After two years of probation, we petitioned for early termination of the California medical license probation.

California Physician Cleared of Negligence in Medical Board Investigation

A California physician received a patient complaint to the Medical Board of California alleging that the doctor had refused to provide the patient with proper pain medications, improperly refused to change medications when the patient had an adverse reaction, ignored test results, and refused to provide proper testing to diagnose and treat the patient's injury.

CA Physicians Licensed After Arrest and Deferred Entry of Judgment

The California Medical Board issued physician and surgeon certificates (medical licenses) to three license applicants who were arrested in different states.  Each of the doctors applying for a California medical license had a criminal case which resulted in deferred entry of judgment rather than conviction.

One was arrested for misdemeanor shoplifting on the East Coast.  The case ended in "Adjournment in Contemplation of Dismissal." There was no guilty plea or conviction.  The charges were later dismissed.
